Welcome to the Galactik MPESA Payments API. By using our API, you agree to the following terms and conditions (“Terms”). These Terms govern your access to and use of the Galactik MPESA Payments API, which acts as an intermediary between your client plugin and the Mpesa API. Please read these Terms carefully before using our services.

1. Acceptance of Terms

By accessing or using the Galactik MPESA Payments API, you agree to be bound by these Terms. If you do not agree to these Terms, you must not use the API.

2. Definitions

  • “API” refers to the Galactik MPESA Payments API provided by Galactik Hosting.
  • “User” or “You” refers to the individual or entity accessing and using the API.
  • “Client Plugin” refers to the software or system integrating with the API.
  • “Mpesa API” refers to the mobile money payment service provided by Safaricom.

3. Use of the API

a. Eligibility

To use the API, you must:

  • Be legally authorized to enter into a binding agreement.
  • Use the API solely for lawful purposes in compliance with these Terms.

b. License

Galactik Hosting grants you a non-exclusive, non-transferable, revocable license to use the API solely for integrating your client plugin with the Mpesa API.

c. Restrictions

You agree not to:

  • Reverse-engineer, decompile, or attempt to extract the source code of the API.
  • Use the API for unlawful purposes or in violation of applicable laws or regulations.
  • Share your API credentials or access tokens with unauthorized parties.

4. Responsibilities

a. Your Responsibilities

You are responsible for:

  • Ensuring the security of your API access credentials.
  • Complying with all applicable laws and regulations related to your use of the API.
  • Handling any end-user data you collect in compliance with privacy laws.

b. Our Responsibilities

We will:

  • Provide the API and reasonable technical support.
  • Take measures to ensure the API’s uptime and reliability.

5. Fees and Payments

Use of the API may be subject to fees, as outlined in a separate agreement or pricing plan. Failure to pay fees may result in suspension or termination of access.

6. Data Handling and Privacy

Use of the API is subject to our Privacy Policy. By using the API, you consent to the collection, use, and sharing of data as described in the Privacy Policy.

7. Limitation of Liability

To the fullest extent permitted by law:

  • Galactik Hosting shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the API.
  • Our total liability for any claim related to these Terms or the API will not exceed the amount paid by you for API access in the last 12 months.

8. Indemnification

You agree to indemnify and hold harmless Galactik Hosting and its affiliates from any claims, damages, liabilities, and expenses (including attorney fees) arising from:

  • Your use of the API.
  • Your violation of these Terms.
  • Any third-party claims related to your use of the API.

9. Termination

a. By You

You may terminate these Terms by discontinuing use of the API and notifying us in writing.

b. By Us

We may terminate or suspend your access to the API if:

  • You violate these Terms.
  • We are required to do so by law.
  • The API is discontinued.

c. Effect of Termination

Upon termination, your access to the API will be revoked, and all licenses granted under these Terms will terminate immediately.

10. Modifications to the API or Terms

We reserve the right to modify or discontinue the API at any time without prior notice. We may also update these Terms, and any changes will be effective upon posting. Continued use of the API constitutes acceptance of the updated Terms.

11. Dispute Resolution

Any disputes arising out of or related to these Terms shall be governed by the laws of [Your Jurisdiction]. Any legal action must be brought exclusively in the courts of [Your Jurisdiction].
